Market Rules and Regulations

 

1. All participants must follow Market guidelines for courtesy, professionalism, and the use of best merchandising practices to present and sell their products and services. Alcohol consumption and smoking are not permitted in the vending area of the market

2. All city ordinances regarding sidewalk traffic, parking, etc will be observed.

3. Vendors requiring electricity will supply their own extension cords that must be a

minimum of 12 gauge and 100 feet.

4. Activities not related to or weakening the objectives of the Market will not be allowed.

5. The Market Manager has been authorized to enforce these Rules and Regulations. The Market  reserves the right to make changes or amendments to these rules as they are justified.

6. The Market will be open from November to mid May. Times of operation are nominally 7:00AM to 1:00PM. Exact dates and times will be communicated in a timely manner in writing by the Market Manager or his designate directly to all vendors and service groups.

7. The vision of the Old Eau Gallie Farmers Market is to be recognized as the premier open-air market experience for all ages and walks of life in our area, and all market participants are expected to reflect our mission of commerce, service, education and outreach.

8. Participants will be assigned spaces by the Market Manager based on seniority, length of commitment to market participation, and vendor balance within the market. Vendors will set up and take down booths precisely at hours agreed upon in advance with the Market Manager. Participants will maintain their spaces in clean, sanitary and attractive conditions. All trash associated with a vendor’s operation will be hauled away by the vendor.

9. Products allowed for sale include fresh fruits and vegetables, nuts, food derivatives, e.g.honey, jams, juices, ice cream, etc., horticultural products, living or cut, seafood and meats, specialty, boutique, arts, and soap products. No mass merchandized,

commodity, second-hand or flea market items are permitted. The integrity of the Market

depends on vendors’ maintaining a high standard of product quality. The Market Manager, together with the Downtown Eau Gallie merchants association, will be the final

authority of products and services sold at The Market.

10. Vendors must provide all necessary permits and official documents, including sales tax, when applicable, for selling their products. Examples are food products including foods cooked at the Market, vinegars, sauces, packaged or cured products. The Old Eau Gallie Farmers Market is not responsible for any loss or damage incurred by vendors due to lack of appropriate permits and controls and vendors agree to hold The Old Eau Gallie Farmers Market harmless and indemnify them from any loss.

11. Effective November 4 2006, the following payment regulations will apply.

A. All required payments are due to the Market Manager before a vendor will be

allowed to participate in the next Market

B. The space fee for a vendor who participates on a continuous basis is $20 per week ( continuous is defined as a minimum 5 week commitment)

C. The space fee for a vendor who does not participate on a continuous basis is $25 per

day of participation.

D. All vendors and potential vendors should contact the Market Manager for

clarification of this regulation.

12. All vendors are fully responsible for the integrity of their products and services. This

includes product spoilage, performance and claims made or implied by the vendor.

Vendors are expected to provide all necessary disclaimers, warnings and other disclosures

to buyers in order to avoid disputes with buyers.

13. No organic materials such as mushroom compost or manure may be sold.
